Terms and conditions
These terms apply to visits, table reservations, group bookings and vouchers at Kleiner Bruder Kaffee in Heidelberg.

1. Scope
These general terms and conditions apply to all contracts between Kleiner Bruder Kaffee GbR, Rohrbacher Straße 47, 69115 Heidelberg (referred to below as we or us) and our guests, including gastronomic services in the café, table reservations, group bookings and the sale of vouchers.
Differing terms of the guest do not apply unless we have agreed to them in writing.
2. Conclusion of contract
In ordinary café operation, the contract is concluded when the order is placed at the counter or at the table and accepted by us.
For a table reservation or a group booking, the contract is concluded when we confirm your request in text form, by email or in a message. A request alone does not constitute a booking.
3. Prices and payment
All prices shown on this website and in the café are in euro and include statutory value added tax. The prices on the printed menu in the café are the ones that apply; where the two differ, the printed menu prevails.
Payment is due immediately after consumption, in cash or by debit or credit card. We accept card payments for any amount, including a single espresso.
For group bookings of more than eight people we may issue a single invoice for the table.
4. Table reservations
We do not accept reservations for tables of five people or fewer. Those tables are given out in the order people arrive.
We do accept reservations for six people or more. A reserved table is held for fifteen minutes after the agreed time; after that we may give it away.
A reservation can be cancelled free of charge up to 24 hours before the agreed time. For groups of twelve or more that are cancelled later than that, or that do not appear, we may charge a flat fee of 5 euro per person, unless you show us that we incurred no loss or a smaller one.
5. Children's birthdays and group bookings
Birthday bookings take place on Sundays between 14:00 and 16:00 for a maximum of twelve people including accompanying adults. A deposit of 30 euro is payable on booking and is offset against the final bill.
You may bring your own birthday cake and we will not charge a corkage fee for it. We cannot store it, refrigerate it or serve it as our own product, and we accept no responsibility for its ingredients or condition.
We do not place group bookings or birthdays into a Ruhezeit block under any circumstances.
6. Ruhezeit and house rules
The Ruhezeit levels published on this website and on the board in the café are a forecast made in good faith by our staff. They are not a warranted characteristic within the meaning of § 434 BGB and they do not form part of any contract. No claim of any kind arises if the room turns out to be louder or quieter than the published level.
During a Ruhezeit block we ask guests to keep telephone calls outside and to keep music and video audible only through headphones. We reserve the right to ask guests who repeatedly disregard this to stop.
We exercise our domiciliary rights and may refuse entry or ask a guest to leave, in particular in cases of harassment, discriminatory behaviour or damage to property.
7. Supervision of children
Responsibility for supervising accompanying children remains with the accompanying adults at all times, including in the play corner.
The play corner is not a supervised childcare facility and no member of our staff is charged with looking after children. We check the equipment daily and clean it weekly, but we accept liability for injuries only within the limits set out in clause 10.
Hot drinks are served hot. We ask you to place them out of a child's reach, and we will serve any drink lukewarm if you ask us to.
8. Allergens and intolerances
We declare the fourteen allergen groups required by Regulation (EU) No 1169/2011 for every item, on the menu in the café and on this website.
Our kitchen is a single room in which gluten, milk, egg, nuts, sesame and other allergens are handled on shared surfaces and in shared equipment. We therefore cannot exclude traces in any dish and give no guarantee of freedom from allergens.
If you have an allergy or an intolerance, please tell the member of staff taking your order before you order. The current recipe folder in the kitchen is the authoritative source of ingredient information and takes precedence over any printed or published menu.
9. Food brought onto the premises
As a rule we ask guests not to consume food or drink brought from elsewhere.
This does not apply to baby food, formula, expressed milk or food required for medical or allergy reasons. Those are expressly welcome, and we will warm a bottle or a jar for you free of charge and without any obligation to purchase.
10. Liability
We are liable without limitation for damage arising from injury to life, body or health caused by a negligent or intentional breach of duty by us or our representatives, and for damage covered by liability under the German Product Liability Act.
For other damage we are liable without limitation only in cases of intent or gross negligence. In the case of slight negligence we are liable only for the breach of an essential contractual obligation, and then limited to the foreseeable damage typical of this kind of contract.
Clothing, prams, changing bags and other items are left in the café at your own risk. We are not an operator of a cloakroom within the meaning of § 701 BGB.
11. Lost property
Items found in the café are kept for four weeks and then passed to the Fundbüro of the City of Heidelberg. Perishable items and open food are disposed of the same day.
12. Vouchers
Vouchers are sold in the café only. We do not sell anything over this website, and this site provides no online shop, so no statutory right of withdrawal for distance contracts arises.
Vouchers are valid for three years from the end of the year in which they were issued. They can be redeemed in part; any remaining value stays on the voucher. They cannot be exchanged for cash.
13. Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the guest is a consumer, this choice of law does not deprive them of the protection of mandatory provisions of the law of their habitual residence.
If the guest is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Heidelberg.
Should any provision of these terms be or become invalid, the validity of the remaining provisions is unaffected.
This is a courtesy translation. In case of any discrepancy, the German version is the legally binding one.
